1. General Conditions of Use and Acceptance thereof

These General Terms of Use, together with the General Terms of Contract and any specific terms that may be established, are intended to regulate the provision of information and the commercial relationships that arise between ALOS PLA SL (hereinafter, "CAGANER.COM") and the USERS of caganer.com (hereinafter, "USERS" or "You").

By browsing the Website and/or by purchasing the products included therein, you acquire the status of USER and accept without reservation of any kind, each and every one of these General Conditions of Use, as well as where applicable the General Conditions of Contract and the Special Conditions.

1.3. CAGANER.COM shall not be liable, either directly or indirectly, for any damages of any kind arising from the use of the Website that is contrary to the provisions of these Terms of Use, or, if applicable, the General Terms and Conditions of Contract and the Special Conditions;

1.4. CAGANER.COM may at any time and without prior notice modify these General Conditions, as well as the General Conditions of Contract, and/or the Special Conditions that may be included, by publishing said modifications on the Website so that they can be known by the USERS.

2. Intellectual and Industrial Property Rights

2.1. This Website, including but not limited to its programming, editing, compilation, designs, logos, images, text, and graphics, is the property of CAGANER.COM and is protected by national and international intellectual property laws. Access to the Website by the USER does not grant them any ownership rights over it.

2.2. The USER authorizes the reproduction, distribution and public communication of the photographs that he inserts into his Intranet account to be published on the Website.

3. Civil Liability

3.1. The products presented on the Website comply with Spanish law. CAGANER.COM cannot be held liable for products that do not comply with the laws of the countries to which they may have been shipped based on the customer's order. Therefore, it is the responsibility of customers outside of Spain to verify the possibility of importing or using the products they order from us.

3.2. CAGANER.COM will be liable for any damages that the USER may suffer as a result of using the Website when such damages are directly attributable to intentional or negligent acts by CAGANER.COM and the USER is not at fault or negligent. In any case, there will be no intentional or negligent acts on the part of CAGANER.COM when it proves that it has complied with the legally and regulatorily established requirements and the other care and diligence required by the nature of the service.

3.3. CAGANER.COM may suspend, withdraw, or cancel, in whole or in part, goods not subject to a contract at any time and without prior notice. The foregoing provision will not affect goods reserved for registered USERS or those subject to a prior contract, which will be governed by their specific terms and conditions.

3.4. CAGANER.COM does not generally control how USERS use the Website, its Intranet, blog, and linked social networks. In particular, CAGANER.COM does not guarantee under any circumstances that USERS will use the Website and these tools in accordance with the law, this Legal Notice, generally accepted morality and good customs, and public order, nor that they will do so diligently and prudently.

4. Warranty Exclusion

4.1. We do not guarantee that the Website will run without interruptions, in a timely manner, reliably, free of errors or viruses and we are not responsible for any damages or losses that may arise from interference, omissions, interruptions, computer viruses or disconnections in the operating system of that electronic system, caused by reasons beyond the control of CAGANER.COM.
